These terms and conditions (the "Terms and Conditions") govern the use of www.steamieclean.com (the "Site"). This Site is owned and operated by Steamie Clean Incorporated (the "Company"). This Site is an ecommerce website.


THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

INTELLECTUAL PROPERTY
All content published and made available on our Site is the property of Steamie Clean and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

AGE RESTRICTION
The minimum age to use our Site is 18 years old. By using this Site, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.

ACCEPTABLE USE
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  • Violate the intellectual property rights of the Site owners or any third party to the Site;

  • Hack into the account of another user of the Site;

  • Act in any way that could be considered fraudulent; or

  • Customer shall not (a) alter or cover up any decals or insignia on the Equipment, remove any operating or safety equipment or instructions or alter or tamper with the Equipment; (b) assign its rights.
     

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

ACCOUNTS
When you create an account on our Site, you agree to the following:
 

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
     

  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.
     

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.
 

SALE OF SERVICE
These Terms and Conditions govern the sale of services available on our Site.
 

The following services are available on our Site:
 

  • Equipment Rental Service; and
     

  • Steam Cleaning Service.
     

The services will be paid for in full when the services are ordered.
 

These Terms and Conditions apply to all the services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our Site at your own risk.
 

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
 

EQUIPMENT RENTAL AGREEMENT

  1. EQUIPMENT RENTAL
    Customer rents equipment from Steamie Clean Inc. The Equipment is described in Steamie Clean Inc's invoice, and the invoice is incorporated herein by reference.
     

  2. TERM
    The rental term will begin on the date the Equipment is delivered and continue until the Equipment is returned to Steamie Clean.
     

  3. USE OF EQUIPMENT
    Customer shall use the Equipment only at the location(s) described on the invoice and for the purpose(s) specified therein. The Equipment shall not be used for any other purpose or at any other location without the prior written consent of Steamie Clean.
     

  4. CARE OF EQUIPMENT
    Customer shall be responsible for the safekeeping of the Equipment and shall use the Equipment in a careful and proper manner. Customer shall comply with any and all instructions furnished by Steamie Clean for the use of the Equipment. Customer shall not pledge or encumber the Equipment in any manner.
     

  5. RISK OF LOSS OR DAMAGE
    Customer assumes all risk of loss or damage to the Equipment from any cause, including theft, vandalism, and Acts of God, from the time the Equipment is delivered to Customer until the Equipment is returned to Steamie Clean.
     

  6. MAINTENANCE AND REPAIR
    Customer shall be responsible for the maintenance and repair of the Equipment, including any damage caused by Customer's negligence, misuse, or abuse. Customer shall not make any alterations, additions, or improvements to the Equipment without the prior written consent of Steamie Clean.
     

  7. RETURN OF EQUIPMENT
    Customer shall return the Equipment to Steamie Clean in the same condition as when received, reasonable wear and tear accepted, on the date specified in the invoice. The Equipment is and shall remain the personal property of Steamie Clean Inc. and shall not be affixed to any other property.
     

  8. DEFAULT
    If Customer fails to pay any amount due under this Equipment Rental Agreement or breaches any other provision of this Equipment Rental Agreement, Steamie Clean may, without notice or demand, declare Customer in default and retake possession of the Equipment.
     

  9. GOVERNING LAW
    This Equipment Rental Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without giving effect to any choice of law or conflict of law provisions.
     

  10. ENTIRE AGREEMENT
    This Equipment Rental Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements or representations, whether written or oral. This Equipment Rental Agreement may not be modified or amended except in writing signed by both parties.
     

  11. BINDING EFFECT
    This Equipment Rental Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, executors, administrators, successors, and assigns.
     

  12. DISPUTE RESOLUTION
    Any dispute arising under this Equipment Rental Agreement shall be resolved through litigation in accordance with the laws of the state where the rental occurred. The parties agree to submit to the exclusive jurisdiction of the state or federal courts located in that state."

 


STEAM CLEANING SERVICE AGREEMENT

  1. SERVICES PROVIDED

The Company shall provide steam cleaning services to the Client at the location specified by the Client. The Services shall be provided on the date and time agreed upon by the Company and the Client.

 

 2. PAYMENT

The Client shall pay the Company the total amount specified on the Company's website at the time of booking. The payment shall be made using the payment method provided by the Company's website.
 

 3. CANCELLATION POLICY

The Client may cancel the Services at any time before the scheduled date and time. If the Client cancels the Services within 24 hours of the scheduled date and time, the Client shall be charged a cancellation fee of 50% of the total amount paid. If the Client cancels the Services within 12 hours of the scheduled date and time, the Client shall be charged a cancellation fee of 100% of the total amount paid.
 

 4. WARRANTIES AND REPRESENTATIONS

The Company represents and warrants that it shall perform the Services in a professional and workmanlike manner, consistent with industry standards. The Client represents and warrants that it shall provide the Company with all necessary access to the Location to perform the Services.
 

 5. LIMITATION OF LIABILITY

The Company's liability to the Client for any claim arising out of this Agreement shall be limited to the amount paid by the Client for the Services. In no event shall the Company be liable for any consequential, incidental, indirect, special, or punitive damages arising out of or in connection with this Agreement.
 

 6. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the state of Pennsylvania, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or in connection with this Agreement shall be brought exclusively in the state or federal courts located in Allentown, Pennsylvania, and each party hereby submits to the jurisdiction and venue of such courts.

 

7. FREE PROMOTIONAL CLEANINGS

Promotional Cleanings are up to the discretion of Steamie Clean Inc. The assigned technician decides what item will be cleaned, how soiled the item is to be cleaned, and how much of the space will be cleaned under this promotion.


 7. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Company and the Client and supersedes all prior negotiations, agreements, and understandings between the parties. This Agreement may not be modified or amended except in writing signed by both parties.

 

PAYMENTS
We accept the following payment methods on our Site:
 

  • Credit Card;
     

  • PayPal;
     

  • Debit; and
     

  • Apple Pay.
     

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Refunds

REFUNDS FOR SERVICE
We provide refunds for services sold on our Site as follows:
 

  • If the scheduled appointment is cancelled at least 24 hours before the services were scheduled you will receive 100% refund. Less than 24 hours we will reschedule your services at the next available appointment time most convenient to you. 
     

CONSUMER PROTECTION LAW
Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
 

LIMITATION OF LIABILITY
Steamie Clean Inc and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
 

INDEMNITY
Except where prohibited by law, by using this Site you indemnify and hold harmless Steamie Clean Inc and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
 

APPLICABLE LAW
These Terms and Conditions are governed by the laws of the Commonwealth of Pennsylvania.
 

DISPUTE RESOLUTION

Subject to any exceptions specified in these Terms and Conditions, if you and Steamie Clean are unable to resolve any dispute through informal discussion, then you and Steamie Clean agree to resolve the issue through litigation in accordance with the laws of the state where the dispute arose. The parties agree to submit to the exclusive jurisdiction of the state or federal courts located in that state. Any costs associated with such litigation will be paid by the unsuccessful party.
 

Notwithstanding any other provision in these Terms and Conditions, you and Steamie Clean agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.
 

SEVERABILITY
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
 

CHANGES
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
